Disclaimer of Liability and Terms of Use

The installation and use of high-current electronic devices such as those developed by Sail for the Sun LLC DBA SeaAir (hereinafter “SeaAir”) carries inherent risks, including fire, electric shock, environmental hazards, exposure to toxic materials, and the potential release of poisonous gasses. By installing and utilizing any device by SeaAir, installer and operator acknowledges and assumes all such risks and agrees to release, indemnify, and hold harmless Sail for the Sun LLC DBA SeaAir, its affiliates, officers, agents, and employees from any and all liabilities, claims, demands, actions, or causes of action, of any kind or nature, arising out of or related to any loss, damage, or injury, including but not limited to personal injury, property damage, or death, that may be sustained as a result of the use of devices.

Installers and operators agree to strictly adhere to all safety guidelines, warnings, and installation instructions provided by SeaAir and to adhere to practices recognized by the general public and professional HVAC installers as common, best practices, safe, and proper when installing and operating SeaAir devices. SeaAir expressly disclaims any and all warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. In no event shall SeaAir be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any other damages whatsoever, including but not limited to damages for loss of profits, business interruption, or loss of information, arising out of the use or inability to use the device, even if SeaAir has been advised of the possibility of such damages.

By proceeding with the installation and use of SeaAir devices, the installer and user acknowledge and agree to the terms and conditions set forth in this disclaimer, and waives any right to claim any form of liability or damages against SeaAir in connection with the use of the device.
